ALTER YOU holds some of the most personal information a person can give an app: your body, your food, your cycle and your photographs. This policy sets out what we collect, why we collect it, who we disclose it to, and how you control it.

This summary is for convenience only. The clauses below govern.
1.1 This Privacy Policy explains how Roxanne Alterio (ABN 80 241 124 181), trading as ALTER YOU, of Queensland, Australia (ALTER YOU, we, us, our) collects, holds, uses and discloses personal information. We are the entity responsible for the personal information described in this policy.
1.2 It applies to the ALTER YOU mobile application, the website at alteryouapp.com, and any communication between you and us (together, the Services).
1.3 We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where you access the Services from the United Kingdom or the European Economic Area, clause 10 also describes rights available to you under the UK GDPR and the GDPR.
1.4 By creating an account you confirm that you have read this policy. Where we rely on your consent, we ask for it separately and you may withdraw it at any time as described in clause 4.3.
2.1 Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, as defined in the Privacy Act.
2.2 Sensitive information means personal information of the kind given special protection under the Privacy Act, and includes health information. Your cycle data, body measurements and progress photographs are sensitive information.
2.3 Account means the ALTER YOU user account created by you.
We do not collect or store your payment card details. Subscriptions are billed by Apple through your App Store account. Apple does not disclose your card number to us.
We collect personal information directly from you. We do not purchase personal information, and we do not enrich your record from data brokers or social media.
4.1 Under APP 3.3 we may only collect sensitive information with your consent and where it is reasonably necessary for our functions. We collect health information because the Services cannot function without it: cycle syncing requires cycle dates, and progress tracking requires measurements and photographs.
4.2 We do not use your sensitive information for any purpose other than those set out in clause 5. We do not use it for marketing, we do not disclose it to advertisers, and we do not use it to train machine learning models.
4.3 You may withdraw consent by deleting the relevant data in the app, revoking a device permission, or deleting your Account under clause 9. Withdrawing consent may mean parts of the Services no longer work.
4.4 Cycle predictions are estimates generated from the dates you enter. They are not a medical diagnosis and must not be relied upon as a method of contraception.

Where the GDPR applies, we rely on: performance of a contract (operating the subscription you have entered into); your explicit consent (health, cycle and photographic data); our legitimate interests in securing and improving the Services; and compliance with legal obligations.
6.1 ALTER YOU uses automated calculations to recommend a program, to set energy and macronutrient targets, and to suggest load increases. These are recommendations only. You may override any of them at any time, and the app shows you the reasoning behind the program it selects.
6.2 These processes do not produce legal effects concerning you and are not automated decision-making of the kind restricted by Article 22 of the GDPR.
7.1 Progress photographs are held in private storage. They are not publicly accessible and cannot be reached by any other user of the Service under any circumstances. Images are served to your own device using short-lived signed links that expire automatically.
7.2 Progress photographs are never published, never used in marketing, never shown to other members, and never used as training data for any model.
7.3 When you delete a photograph, or delete your Account, the underlying image file is deleted from storage, not merely the database record referring to it.
7.4 Challenge judging uses your logged training data together with the before and after photographs you submit when you enter. Those photographs are viewed only by us, only for judging, and are never published or shared without your separate written consent. You may withdraw a photograph at any time by emailing info@alteryouapp.com, which withdraws your entry from judging.
8.1 We do not sell, rent or trade personal information.
8.2 We disclose personal information only to the service providers that operate the Services:
8.3 Each provider is bound to use the information only to supply services to us.
8.4 We may also disclose personal information where required or authorised by law, where necessary to prevent a serious threat to life, health or safety, or to establish or defend a legal claim.
8.5 If our business is sold or merged, personal information may transfer to the acquirer, who will be bound by this policy or a policy at least as protective. We will notify you before any such transfer takes effect.
9.1 Some of the providers named in clause 8.2 store data outside Australia, so your personal information may be stored or accessed overseas.
9.2 Before disclosing personal information overseas we take steps that are reasonable in the circumstances to ensure the recipient does not breach the APPs, as required by APP 8.
10.1 We retain personal information while your Account remains open, so that your history and progress records remain meaningful to you.
10.2 You may delete your Account at any time from within the app, under Settings. You do not need our permission and you do not need to email us.
10.3 When you delete your Account your personal data is permanently deleted, including your training logs, measurements, cycle data and image files. We retain only information we are required by law to keep, such as financial records held under taxation law.
10.4 Deleting your Account does not cancel your Apple subscription. You must cancel that separately in your device settings.

11.2 Send requests to info@alteryouapp.com. We will acknowledge within 5 business days and respond substantively within 30 days. We do not charge for access requests.
11.3 We may need to verify your identity before acting on a request. If we refuse a request, we will tell you why in writing and how to complain.
12.1 If you believe we have breached the APPs, write to our Privacy Officer at info@alteryouapp.com. We will investigate and respond within 30 days.
12.2 If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner at oaic.gov.au, by telephone on 1300 363 992, or by post to GPO Box 5218, Sydney NSW 2001.
13.1 Personal information is encrypted in transit and at rest. Passwords are hashed and are never stored in a readable form, including by us. Access to your records is enforced at the database level, so your data is retrievable only by your own authenticated Account.
13.2 No method of transmission or storage is completely secure. If an eligible data breach occurs that is likely to result in serious harm, we will notify affected individuals and the OAIC as required by the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act.
14.1 We send marketing emails only to people who have opted in. The consent box at sign up is unticked by default and we will never pre-tick it. This does not affect service messages necessary to operate your Account.
14.2 Every marketing email contains a functional unsubscribe facility, in accordance with the Spam Act 2003 (Cth). We will action an unsubscribe request within 5 business days.
14.3 We never use sensitive information, including cycle or photographic data, to target marketing.
14.4 Where you enter your details into a form on this website, such as a challenge waitlist or an event registration, we record your name, email address and the answers you gave, together with whether you ticked the marketing consent box. Without that tick we will only contact you about the specific thing you signed up for.
14.5 That list is held in our Supabase database, is accessible only to us, and is never sold, rented or shared with any third party. You may ask to be removed from it at any time by emailing info@alteryouapp.com, and we will action the request within 5 business days.
15.1 The Services are not directed to, or intended for, individuals under 16. We do not knowingly collect personal information from children.
15.2 If you believe a child has created an Account, contact us and we will delete it and the associated data.
16.1 This website does not use advertising cookies, tracking pixels or third-party advertising networks. We do not sell or share visitor data with advertisers.
16.2 We use privacy-focused, cookieless analytics to understand how the website is used in aggregate: which pages are visited, which links are clicked, and which country visitors arrive from. It sets no cookies, does not follow you across other websites, and does not build a profile of you. We cannot identify an individual visitor from it.
16.3 Analytics events record the action taken and the page it happened on. They never include your name, email address, or anything you have typed into a form.
16.4 Your browser may store a small amount of local data so that a message you have already dismissed does not reappear during the same visit. This is not used to identify you.
The Services may link to third party websites, including the Apple App Store. We are not responsible for the privacy practices of those sites, and we encourage you to read their policies.
18.1 We may update this policy. The version number and effective date at the top of this page will change.
18.2 Where a change materially affects how we handle your personal information, we will notify you in the app or by email before it takes effect.
